Delaware is a tiny state on a massive corridor. I-95 carries more daily traffic than any other interstate in the United States, and Delaware sits between three major metro areas: Philadelphia (30 minutes north), Baltimore (1 hour south), and Washington, D.C. (90 minutes southwest). Each of these metro areas is in a different state with different cannabis laws.

This creates a unique border-driven cannabis market. Pennsylvania has 13 million residents and no recreational cannabis, making Delaware dispensaries — particularly those in New Castle County near the PA border — a powerful draw. Cannabis Cannot Cross State Lines

This is the single most important rule for I-95 travelers: cannabis cannot legally cross any state border, even between two states where it's legal. Transporting cannabis from Delaware into New Jersey or Maryland is a federal offense under the Controlled Substances Act. State legalization does not override federal interstate commerce law.

Travel Tips for I-95 Travelers

  • Buy and consume in the same state. If you're passing through Delaware on I-95, purchase only what you'll use in Delaware. Do not bring it home.
  • No consumption in your vehicle. Delaware prohibits open containers of cannabis in the passenger area of a vehicle, similar to open container laws for alcohol. This applies even if the vehicle is parked.
  • Possession limit is 1 oz. Delaware allows up to 1 ounce of flower, 12g of concentrates, or 750mg THC in infused products. Exceeding these limits carries escalating penalties.
  • Store purchases in the trunk. Keep any cannabis products in a sealed container in the trunk or cargo area, out of the passenger compartment, especially when driving on I-95.
  • Know the tolls. I-95 through Delaware has tolls. The Delaware Memorial Bridge connects to New Jersey. Budget for these if you're making a round trip.
