What PA Residents Need to Know

Buying in Delaware

  • You can buy. Delaware does not require state residency to purchase recreational cannabis. Any adult 21+ with a valid government-issued photo ID can purchase at a licensed dispensary.
  • Same limits as residents. 1 oz of flower, 12g concentrates, or 750mg THC in infused products.
  • Cash is common. Many dispensaries are cash-only or have limited card payment options. ATMs are typically available on-site.

The State Line Problem

This is where it gets serious: you cannot bring cannabis back to Pennsylvania. Transporting cannabis across the Delaware-Pennsylvania border is a federal offense, regardless of how much you have or that it was legally purchased. It is also a state crime in Pennsylvania, where possession without a medical card remains illegal.

Driving cannabis from Delaware into Pennsylvania is both a federal offense (interstate transport of a controlled substance) and a Pennsylvania state crime (possession without a medical card).
