Delaware Cannabis Licensing

Delaware capped its initial cannabis market at 125 licenses across four categories. The OMC received 1,269 applications and awarded all licenses through lotteries in late 2024 — but no new retail stores have opened yet.

License Types and Caps

Delaware's Marijuana Control Act (HB 2) established four license categories with firm caps for the initial market:

These 125 licenses are further divided among open, social equity, and microbusiness categories, ensuring that the market is not dominated solely by large, well-capitalized operators.

The Application Window and Lottery

The OMC opened its first application window during August–September 2024. The response was enormous for a state Delaware's size:

  • 1,269 applications submitted across all license categories
  • More than $4 million generated in application fees alone
  • Standard application fee: $5,000 (social equity applicants: $1,000)

Because demand far exceeded the 125 available licenses, the OMC used a lottery system rather than a scored merit-based review. Lotteries were conducted in October and December 2024, awarding all 125 initial licenses.

Current Market Status (March 2026)

As of March 2026, the new licensing program is still in its early stages:

  • 16 conditional retail licenses have been issued by the OMC
  • Zero new retail stores have opened — license holders are still completing buildout, inspection, and compliance requirements
  • License holders have an 18-month window from the date of conditional approval to become operational
  • First new retail locations are expected to open in mid-to-late 2026
  • Full market buildout is not anticipated until 2027

In the interim, all recreational and medical sales continue through the existing compassion centers that were licensed under Delaware's original medical program. These legacy operators are currently the only storefronts serving the entire state.

No New Application Windows Yet

All 125 initial licenses have been awarded through the 2024 lotteries. As of March 2026, the OMC has not announced a timeline for additional licensing rounds. Monitor omc.delaware.gov for updates.

Application Requirements

While the initial window has closed, understanding the requirements helps prospective applicants prepare for future rounds:

  • Background checks for all owners and key personnel
  • Financial disclosures including proof of capitalization
  • Proposed location meeting zoning and buffer zone requirements
  • Operating plan covering security, inventory tracking, waste disposal, and staffing
  • Local government approval where required by municipality
  • Social equity documentation if applying under equity provisions
